Terms of Service - ScrollBuddy

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the ScrollBuddy iOS application ("App") operated by ScrollBuddy ("we," "us," or "our"). By accessing or using our App, you agree to be bound by these Terms and our Privacy Policy.

If you are using ScrollBuddy on behalf of an organization, you agree to these Terms on behalf of that organization and represent that you have the authority to do so.

2. Eligibility

To use ScrollBuddy, you must:

Be at least 13 years of age
Have the legal capacity to enter into these Terms
Not be prohibited from using the App under any applicable laws
Have a compatible iOS device with a supported iOS version

If you are under 18, you must have parental or guardian consent to use the App.

3. Subscription & Payment Terms

Premium Subscription

ScrollBuddy offers premium features through auto-renewing subscriptions:

Monthly Plan: Billed monthly at the displayed price
Annual Plan: Billed yearly at the displayed price

Billing & Renewal

Payment will be charged to your Apple ID account at confirmation of purchase
Subscription automatically renews unless canceled at least 24 hours before the end of the current period
Your account will be charged for renewal within 24 hours prior to the end of the current period
You can manage and cancel subscriptions in your Apple ID Account Settings

Free Trial

If offered, any unused portion of a free trial period will be forfeited when you purchase a subscription.

Price Changes

We reserve the right to change subscription prices. Price changes will take effect at the start of the next subscription period following the date of the price change. You will be notified in advance of any price changes.

Refund Policy

To be honest, if you are nice and request a refund and provide great feedback! You will get it but if not: All purchases are final and non-refundable, except as required by law or as determined by Apple's refund policies. To request a refund, you must contact Apple directly through your purchase history in the App Store.

4. License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use ScrollBuddy for your personal, non-commercial use.

This license does not include the right to:

Modify, adapt, or hack the App
Reverse engineer or attempt to extract the source code
Copy, distribute, or create derivative works
Use the App for any illegal or unauthorized purpose
Violate any laws in your jurisdiction

5. User Accounts & Security

When you create an account, you agree to:

Provide accurate and complete information
Maintain the security of your account credentials
Promptly notify us of any unauthorized use
Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or illegal activities.

6. Acceptable Use Policy

You agree not to use ScrollBuddy to:

Violate any applicable laws or regulations
Infringe on the rights of others
Transmit harmful, offensive, or illegal content
Attempt to gain unauthorized access to our systems
Interfere with or disrupt the App's functionality
Use automated systems to access the App
Impersonate another person or entity
Share your account with others

7. Accountability Partner Feature

The accountability partner feature allows you to designate another user or AI to approve unlock requests. By using this feature:

You consent to share unlock requests with your designated partner
You understand that partners can approve or deny your requests
You agree not to harass or pressure partners for approvals
You acknowledge that AI partner decisions are automated and may not always align with your expectations

We are not responsible for decisions made by your accountability partners or for any consequences resulting from approved or denied requests.

8. Intellectual Property

ScrollBuddy and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

Any feedback, suggestions, or ideas you provide about ScrollBuddy become our property and may be used without compensation to you.

9. Disclaimers & Limitations

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.

We disclaim all warranties, express or implied, including but not limited to:

Merchantability and fitness for a particular purpose
Accuracy, reliability, or completeness of content
Uninterrupted or error-free operation
Security or freedom from viruses or malware

Health Disclaimer: ScrollBuddy is not a medical device or treatment. It should not be used as a substitute for professional medical advice, diagnosis, or treatment of technology addiction or any other condition.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, or consequential damages
Loss of profits, data, use, or goodwill
Service interruptions or data breaches
Damages exceeding the amount you paid us in the past 12 months

These limitations apply whether based on warranty, contract, tort, or any other legal theory, and whether or not we have been advised of the possibility of such damages.

11. Indemnification

You agree to indemnify, defend, and hold harmless ScrollBuddy, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use or misuse of the App
Your violation of these Terms
Your violation of any third-party rights
Any content you submit or share through the App

12. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including:

Breach of these Terms
Fraudulent or illegal activity
At our sole discretion

Upon termination, your right to use the App will immediately cease. All provisions of these Terms that should survive termination shall survive, including ownership, warranty disclaimers, and limitations of liability.

13. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of ScrollBuddy shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that you may bring claims in small claims court if eligible.

You waive any right to a jury trial or to participate in a class action lawsuit.

14. Apple-Specific Terms

If you access ScrollBuddy via an iOS device:

Apple is not a party to these Terms
Apple has no obligation to provide maintenance or support
Apple is not responsible for any product claims or liabilities
In case of App failure to conform to warranties, you may notify Apple for a refund
Apple and its subsidiaries are third-party beneficiaries of these Terms

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms in the App and updating the "Last updated" date. Your continued use of ScrollBuddy after changes constitutes acceptance of the modified Terms.

16. Miscellaneous

Entire Agreement: These Terms constitute the entire agreement between you and ScrollBuddy.

Severability: If any provision is found unenforceable, the remaining provisions will continue in effect.

Waiver: Our failure to enforce any right or provision is not a waiver of that right.

Assignment: You may not assign or transfer these Terms. We may assign our rights to any successor.

Force Majeure: We are not liable for delays or failures due to causes beyond our reasonable control.
